Welcome to applemountainresort.com, operated by Apple Mountain Residences & Golf Club ("we," "us," or "our"). By accessing or using this website, applying for a residence, signing a lease, or visiting our facilities, you agree to be bound by these Terms & Conditions. Please read them carefully.
Acceptance of Terms
By accessing this website or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our website or services.
We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the website following any changes constitutes acceptance of the revised terms.
Use of Website
You agree to use this website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use and enjoyment of the site. You may not:
- Use the website in any way that violates applicable federal, state, or local laws
- Attempt to gain unauthorized access to any portion of the website or its systems
- Use automated tools (bots, scrapers, crawlers) to access or collect data from the website without our written permission
- Transmit any harmful code, viruses, or malicious software
- Misrepresent your identity or affiliation with any person or organization
Leases & Applications
Application & Approval
All residence leases are subject to application, screening, and availability. A residence is not held until you receive written approval and a signed lease agreement. We reserve the right to decline any application consistent with applicable fair housing laws.
The lease holder must be at least 21 years of age and must occupy the residence during the lease term.
Pricing & Payment
All rents are quoted in U.S. dollars per month and are subject to applicable taxes, fees, and any utility pass-throughs described in the lease. We reserve the right to correct pricing errors. A security deposit and any move-in costs are due at lease signing.
Early Lease Termination
If you need to end your lease early, the early termination terms in your lease agreement apply. Generally an early termination fee plus the deposit handling specified in the lease will be charged. We try to work with residents in good standing on life events. Please contact the front office before deciding to break a lease.
Renter's insurance is required. Specific lease terms govern in all cases.
Move-In & Move-Out
- Move-in: Scheduled with the front office after approval and lease signing.
- Move-out: By the date specified in the lease, with a final walkthrough at the front office.
Early move-in or late move-out may be available upon request and is subject to availability and a possible prorated fee per the lease.
Occupancy
The number of occupants in a residence cannot exceed the maximum occupancy listed on the lease for that residence type. All occupants over 18 must be named on the lease. Unauthorized occupants may result in fees or lease default per the lease agreement.
Property Rules
Quiet Hours
Quiet hours are from 10:00 PM to 7:00 AM. Please be respectful of your neighbors and neighboring properties. Apple Mountain is a family-friendly residential community in the mountains.
Smoking Policy
No smoking, vaping, or use of illegal substances is permitted anywhere on the property, including inside units, on patios, balconies, or common areas. Violation of this policy will result in a cleaning fee of up to $300.
Pet Policy
Pets must be pre-approved before move-in. Only house-trained pets under 50 pounds may be considered. A pet fee and pet deposit will be agreed upon based on your pet's specifics. Unapproved pets or violations of pet rules may result in fees up to $100 per incident.
Service animals are welcome and are not subject to pet fees. Please inform us at application.
Golf Course & Amenity Rules
- All guests must follow posted rules at the golf course, pool, and common areas
- Children under 14 must be supervised by an adult in the pool area
- No glass containers in pool area
- Proper golf attire is required on the course
- Golf carts must remain on designated paths
- Use of all amenities is at your own risk
Parking
Each unit includes designated parking. Oversized vehicles, trailers, and RVs must be pre-approved. Please do not park in fire lanes or block other guests.
Resident Responsibilities
Damage & Liability
Residents are financially responsible for any damage to the residence or property beyond normal wear and tear. Please report any damage or maintenance issues immediately. We reserve the right to charge the credit card or payment method on file (or apply the security deposit) for damages discovered after move-out.
Move-Out Requirements
Before move-out, please:
- Remove all personal belongings
- Bag and remove trash to the designated dumpster
- Return furniture and provided items to their original positions
- Close and lock all windows and doors
- Return key cards and access devices to the front office
- Complete the final walkthrough with a staff member
Residences left excessively dirty or requiring extensive cleaning beyond normal turnover may incur an additional cleaning fee deducted from the security deposit.
Lost & Found
We are not responsible for items left behind. If you believe you left something, contact us within 7 days. We will attempt to locate the item and arrange return shipping at your expense.
Commercial Use
No commercial photography, filming, or events are permitted on the property without prior written approval from management.
SMS Text Messaging Terms
By providing your mobile phone number to Apple Mountain Residences & Golf Club, you agree to the following SMS terms:
- Program Description: Apple Mountain Residences & Golf Club sends operational text messages including missed-call alerts to staff, lease confirmations and move-in instructions, leasing follow-ups, service updates, and responses to inquiries.
- Consent: By providing your phone number through our website, leasing application, or directly to our staff, you consent to receive text messages from Apple Mountain Residences & Golf Club at the number provided. Consent is not a condition of any application or lease.
- Message Frequency: Message frequency varies based on your activity and the nature of the communication.
- Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details about your plan.
- Opt-Out: Reply STOP to any message to unsubscribe. You will receive one confirmation message and no further messages will be sent, except as required to respond to transactional requests you initiate.
- Help: Reply HELP for assistance, or contact us at (706) 471-3671.
- Supported Carriers: Our messaging program is compatible with major U.S. carriers, including AT&T, Verizon, T-Mobile, and Sprint. Carriers are not liable for delayed or undelivered messages.
- Privacy: Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details on how we handle your information.
Limitation of Liability
Apple Mountain Residences & Golf Club, its owners, operators, employees, and agents shall not be held liable for any injury, loss, damage, or expense arising from:
- Your occupancy of a residence or use of any amenities, including the golf course, pool, and common areas
- Loss or theft of personal property
- Weather-related disruptions, natural disasters, or other force majeure events
- Actions or negligence of other guests or third parties
- Interruption of utilities or services beyond our reasonable control
Our total liability for any claim arising from your use of this website or occupancy of a residence shall not exceed the total amount you have paid us in the prior 12 months. This limitation applies except where caused by our gross negligence or willful misconduct.
Intellectual Property
All content on this website, including but not limited to text, images, graphics, logos, videos, and design elements, is the property of Apple Mountain Residences & Golf Club or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, display, or create derivative works from any content on this website without our prior written consent.
Indemnification
You agree to indemnify, defend, and hold harmless Apple Mountain Residences & Golf Club, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the website or violation of these terms
- Your occupancy of a residence, including any damage to property
- Any violation of applicable laws or regulations
- Any dispute between you and a third party related to your use of our services
Disclaimer of Warranties
This website and all content, services, and information provided through it are offered on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our website or services shall be resolved exclusively in the state or federal courts located in Habersham County, Georgia. By using this website, you consent to the jurisdiction and venue of such courts.
Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. The terms in effect at the time of your lease signing will apply to that engagement. We encourage you to review these terms periodically.
